French court rules in favor of Mozambican state in case against Indiana Patel Engineering

The Arbitral Tribunal of the International Court of Arbitration (ICC), based in Paris, France, has handed down its verdict in the arbitration case brought by the Mozambican state against Indian giant Patel Engineering..

Represented by the Mozambican Attorney General's Office (PGR), the state brought this action to counter another action brought by Patel Engineering against the state (which the state also won), claiming compensation of more than 115 million dollars for the alleged losses it had incurred, allegedly incurred with the pre-feasibility study, under the Memorandum of Intent signed with the Ministry of Transport and Communications (MTC) in 2011, and with the failure to award it the concession to build the Moatize-Macuse railway line and the Port of Macuse.

After two years of intense battle, the PGR welcomes this decision as the Mozambican state has prevailed in all the contractual claims and arguments, with Patel Engineering losing the case and now having to reimburse the state for all the costs incurred in the process.

According to a Sunday newspaperAccording to the PGR, "this decision marks the end of Patel Engineering's unsuccessful maneuvers to unduly withdraw more than 115 million dollars from state coffers".
