Tmcel - Moçambique Telecom, S.A., aware of the recent reports of a possible strike or demonstration by some workers, reiterates its commitment to complying with the agreements reached and reinforces the importance of observing the legal procedures established for these actions, always favoring dialogue and mutual understanding.
According to current labor legislation (Law no. 13/2023, of August 25 - Labor Law), the right to strike, although fundamental, is subject to specific formalities, which are not being complied with by the workers.
The decision to strike must be taken in a representative manner by the Works Council, after consulting all the workers, which did not happen in this case. Therefore, the announced strike or demonstration is flawed in form and content and is considered unlawful under current regulations.
With regard to the commitments made by Tmcel, the company reiterates that it has honored them:
1. Payment of salaries: since the appointment of the current Management Committee, workers' salaries have been paid on time, even in the face of financial challenges;
2. Wage harmonization: a transparent process agreed with the Works Council is underway, with completion scheduled for March 2025, aimed at correcting wage disparities;
3. Retroactive payments and allowances: the payment of vacation allowances for 2023 began to be made in stages, depending on availability, as of this January, and
4. Thirteenth salary for 2024: this will be paid as soon as conditions permit. As has been reiterated in various letters and meetings with the Trade Union Committee, a significant number of clients are not honoring their payments, putting certain obligations at risk, such as compliance with the payment of certain allowances, such as vacation pay and the 13th salary, as well as other current investments.
Accordingly, Tmcel calls on the demonstrating workers to use the mechanisms for dialogue and negotiation provided for in the Company Agreement and in labor legislation, as these actions do nothing to resolve the workers' concerns and run counter to the joint efforts that have been made to revitalize the company.
We reiterate our total openness to continue working together on Tmcel's recovery process, whose indicators show that we are on a good path, albeit a long one, and in the search for solutions that benefit everyone involved, always respecting the principles of legality and good faith.
