The Mozambican Bar Association (OAM) has set up a commission of inquiry with the aim of gathering as much information as possible on the insolvency process of Cimentos da Beira (CdB).
More specifically, the OAM intends to investigate the ethical conduct of the lawyers involved in the case in order to take action according to the findings.
The special insolvency of CdB was determined by the Sofala Provincial Court in October 2024, without having heard the workers of what was, until then, the largest producer of construction cements in the center of the country, reports the newspaper. STV.
In the aftermath, CdB started adding up debts and not paying the wages of the workforce, resulting in apparent bankruptcy.
Three months later, the same court appointed three lawyers as the company's insolvency administrators, one of whom is accused by the workers of embezzling more than seven million meticais from the sale of cement.
The OAM has learned of the dissatisfaction with the attitude of the lawyers and the court in the insolvency proceedings.
At DeliberationThe OAM says that the information on the subject published in the media points to a violation of the Order's ethics and "a violation of the rules on preventing, suppressing and combating money laundering, terrorist financing and the proliferation of weapons of mass destruction".
The commission of inquiry has 10 days from April 1, 2024 to gather the information and present a report on the findings. "If it can", it will have to hear the lawyers (trustees and insolvency administrators), liaise with the Commercial Section of the court it follows, with the Central Office for Combating Corruption, the Central Office for Combating Organized and Transnational Crime, among other relevant institutions.
