DECIDES to submit a precautionary measure to prevent the destruction of electoral material

DECIDE submete providência cautelar para impedir destruição de material eleitoral

On Tuesday, the Decide Electoral Platform filed a request for an injunction with the courts to prevent the destruction of electoral material for the October 9, 2024 general elections.

The civil society organization believes that the material produces sufficient probative evidence and reveals a serious probability that the rights of Mozambicans are being threatened.

The National Electoral Commission (CNE) may today proceed to destroy all the electoral material from last October's ballot.

In the opinion of Plataforma Eleitoral Decide, the CNE should not do this, since the material has not yet been definitively recognized by the African Court of Human and Peoples' Rights.

"If the injunction is not issued, the applicant's rights and those of Mozambicans in general will be curtailed" and, consequently, it will be impossible to prove and recognize the truth of the election.

On the other hand, it says that, due to an error, the CNE decision authorizing the destruction of the material from the general elections of 9 October 2024 "is inoperative and cannot stand". Resolution 87/CNE/2024 of December 30 states that the material should be destroyed on January 17, 2024 and not "January 17, 2025".
