Maluana's Accident: EMOSE appeals the Manhiça Court's decision to pay a fine of over 33 million meticais

The Mozambican Insurance Company (EMOSE) said today that it will appeal the decision of the Judicial Court of Manhiça District, in Maputo province, for the payment of a fine of over 33 million meticals, related to the traffic accident involving the Nhancale carrier, which killed 32 people, last year, in Maluana.

The joint and several amount stipulated by the Manhiça Court was for the payment of compensation to the victims' families.

The insurer received the fine because it allegedly failed to notify the carrier to renew the insurance policy. Nhancale's insurance lapsed and Emose failed to give the customer timely notice to renew.

Emose's Technical and Operational Area Administrator explained that the claim is not payable because the insurance policy with the carrier had lapsed some time ago.

"Having not paid the fraction he suffered in November 2020, the insurance contract became null and void and of no effect. So it was a contract that the anniversary date was February to February. Therefore, having not paid, there was no contract. In all honesty, we would like to clarify that at the date of the accident there was no contract with EMOSE", said, Benedito Manhiça, quoted today by RM.

The official made it clear that that insurance contract has expired "by force of law," and, as such, "we will appeal.

According to EMOSE, the allegation of lack of notice to Nhancale about the expiration of the mandatory insurance policy is not true.
