Constitutional Council could announce decision on CAD appeal today

The Constitutional Council could announce today, Wednesday (31), its decision on the appeal submitted by the Democratic Alliance Coalition (CAD) regarding the decision of the National Electoral Commission (CNE), which declared its candidacy for the legislative and provincial assembly elections on October 9 null and void.

According to a NewsAccording to the law, the Constitutional Council has up to five working days from the date of receipt of the file to announce the outcome of the appeal, after analyzing the arguments put forward by each of the parties, namely the CAD and the CNE.

A few days ago, the CNE excluded the Democratic Alliance Coalition (CAD), which supports the presidential candidacy of politician Venâncio Mondlane, from the October general elections, for not meeting the legal requirements.

"The closed plurinominal lists of candidacies of the Democratic Alliance Coalition are rejected due to the fact that they do not meet the legal requirements for the presentation of candidacies, which results in the nullity of their candidacy process," said Paulo Cuinica, spokesman for the CNE, when he read out the decision, by consensus, on the verification of the candidacies received.

According to the CNE, after examining the file submitted by the applicant, the electoral process governing body found that only the document proving the approval of the coalition agreement had been sent, while other documents such as the definition of the scope of the coalition were missing. Furthermore, they did not attach the entries made in the registers of each political party that is part of the coalition.

It was also noted, according to the body, that the DAC agreement was signed on April 27, 2024 and communicated to the Ministry of Justice, Constitutional and Religious Affairs on June 18, 2024, thus violating the deadline set out in Article 8(3) of the aforementioned law.

This article imperatively establishes that the political parties in the coalition have fifteen days from the date of signing the agreement to notify the Ministry of Justice, Constitutional and Religious Affairs for the purposes of registration.

Furthermore, in the CNE's view, it is the duty of political parties to notify the competent body of the registration.

For its part, CAD disagreed with the decision rejecting its candidacy and assured that it was duly registered, under the terms of decision number 59/CNE/2024, of May 9.
