Frelimo party veteran Óscar Monteiro argues that the same citizen cannot simultaneously hold the positions of President of the Republic (PR) and of a political party. In this case, this separation of functions should be observed from the next legislature.
For Óscar Monteiro, one of the first Mozambican jurists, the adoption of this perspective will demonstrate respect for the Constitution of the Republic of Mozambique (CRM). However, he also suggests the intervention of the Constitutional Council to force, through legal channels, the resignation of one of the posts and functions.
In his article "Frelimo Party Serves Greater Causes", he questions whether or not it is a flagrant violation of CRM for the country to have a PR who is President of a political party. He replies: ".... Immediate resignation of the President of the Frelimo Party from his position in the Party. This resignation should, ideally, be voluntary and, failing that, such a decision should be taken by the respective party bodies and, ultimately, imposed by the competent state body, which can only be the Constitutional Council."
The veteran of the national liberation struggle recognizes that the issue may even be extemporaneous, but proposes the "emancipation of the state" by the parties. He also points out that this violation of the CRM has crystallized over the years in which Frelimo has led the country.
"Repeated violation of a constitutional rule does not create a constitutional 'custom', unlike what happens at the level of ordinary legislation in the context of administrative law," writes the politician, quoted by "O País".
And in order to respect CRM, the first step to be taken depends on the initiative of the Frelimo party itself, he noted.
"Over time, Party officials stopped being motivators, mobilizers, they became officials of the apparatus, they became the all-powerful Party," he said.
