CC president invites academics to debate "constitutional complaint"

Presidente do CC convida académicos a debater “queixa constitucional”

The Venerable President of the Constitutional Council (CC), Lúcia da Luz Ribeiro, invited the academic community to think about the arguments in favor of and criticisms of the introduction in Mozambique of a certain measure of amparo, also known as a constitutional complaint.

The invitation was made yesterday (22) in Maputo, at the closing of the ninth Lusophone Law Congress, organized by the Faculty of Law of the Eduardo Mondlane University in partnership with the Lusophone Law Research Network (REDIL), as well as the Justice and Governance Research Centre (JusGov) of the Law School of the University of Minho (Portugal).

The constitutional complaint or amparo appeal is configured as a protection mechanism designed to control ablative interventions in citizens' fundamental rights caused by any administrative decision, judicial decision or normative act.

According to the note in which the President of the CC is quoted, the complaint is a procedural means that is distinguished by its basis: there is direct access to the constitutional judge if the rights of individuals have been harmed.

"We've been thinking about how academics can influence the adoption of the appeal for amparo or the constitutional complaint in the Portuguese legal system. The aim is for citizens to have more and more access to constitutional jurisdiction," said the President of the CC.

Ribeiro pointed out that the event brought together several legal academics and scientists and others to discuss various legal interests in the four corners of the world where Portuguese is spoken.

In the words of the President of the CC, this ninth edition promoted reflection on the problem of applying the law in its many dimensions.

As in previous editions, we highlight the links with research and teaching projects in other countries that share a cultural, linguistic and legal heritage.

"The congress served to create and consolidate relations between our institutions," he concluded.

The theme of the congress, which ended yesterday, was "Governance, Justice and Sustainable Development".
