The President of the Republic, Filipe Nyusi, has returned the electoral legislation to Parliament for re-examination, as there are articles that raise doubts.
A press release quoted by "Notícias" says that this is Article 196A (1) on the election of the President of the Republic and Members of Parliament, which stipulates that, "If there is evidence of irregularities at any polling station that jeopardize the freedom and transparency of the electoral process, the district court, the National Elections Commission or the Constitutional Council, as the case may be, shall order a recount of the votes from the polling stations where the irregularities took place."
In the same law, Article 8(4A) is questioned: "The matter of the decisions of the polling stations, of the district tabulation that has been the subject of contentious appeal...".
The same applies to the text introduced in Article 161(4A) and Article 167(1) of the Law Revision Act No. 3/2019 of May 31, on the election of members of provincial assemblies and the provincial governor.
