The Mozambican Bar Association (OAM) defends the transformation of the Constitutional Council (CC) into a Constitutional Court as a way of guaranteeing the operationalization of this body.
Speaking at the opening of the Judicial Year - 2024, an event that took place under the theme: "Strengthening the Role of the Judiciary in Combating Drug Trafficking", Carlos Martins said that this action aims to allow an effective change in the constitutional regime as well as the expansion of the entities with legitimacy to trigger its reaction, such as the Bar Association itself.
"We have argued that it is precious and indispensable to transform the Constitutional Council into a Constitutional Court, which would act as the guardian of constitutional commitments," he said, quoted by AIM, adding that countries such as Angola and Brazil have already extended the legitimacy of the CC's reaction to their Bar Associations, which is why they advocate that the example be followed in Mozambique.
OAM also expressed its dissatisfaction with the electoral processes in Mozambique, advocating the extension of the discussion of electoral legislation outside Parliament.
"It is not enough to reduce the field of discussion of this issue to the Assembly of the Republic, the discussion of electoral legislation must be comprehensive, away from electoral cycles, with contributions from all those who, through its application, have identified flaws, illegalities, inconsistencies and even unconstitutionalities, namely lawyers, judicial magistrates and public prosecutors, law and political science professors, political parties and civil society in general," he concluded.
