Government publishes Port of Maputo concession contract and addenda

The Government publishedThis week, the Ministry of Transport and Logistics announced the contract and respective addenda for the concession of the Port of Maputo.

In a statement, the institution said that the measure will cover all concessions in the sector.

The document states that the measure is in line with the principles of good governance, accountability and the fight against corruption.

"The publication of concession contracts allows citizens to have direct access to the conditions agreed between the state and the concessionaires, contributing to the strengthening of public confidence and the supervision of projects of national interest," it reads.

However, the Ministry notes that, for justifiable and legal reasons, there are clauses that will not be published and must remain confidential. The argument is some clauses are omitted because they contain commercial and strategic data whose disclosure could harm the business position of the State or the concessionaire, unduly favor competitors or compromise the proper execution of the contract.

"[the] publication of contracts respects the balance between the right to information and the need to protect sensitive information," he said.

The Ministry of Transport and Logistics is now negotiating the specific terms of publication of their contracts with each concessionaire. As the non-confidential versions are finalized and approved, they will be published in stages on the Ministry's website and on the websites of the relevant sector regulators, the statement said.
