The Constitutional Council (CC) dismissed the Renamo party's appeal on the grounds that it had not found any evidence of falsity in the minutes and notices presented by the National Electoral Commission for the sixth local elections on October 11, 2023.
On November 29, the Renamo party filed a criminal complaint against the president of the Constitutional Council, Lúcia da Luz Ribeiro, and six other judges of that body, alleging the "commission of criminal offenses in the exercise of their functions".
According to Renamo, those judges "validated the election results using documents that showed strong signs of falsity," referring to the minutes and notices of the October 11 municipal vote.
However, the PGR concluded that, with regard to the allegations of falsification of minutes and public notices, and the use of false documents, Renamo, before reporting the matter to the Public Prosecutor's Office, used its own procedural means and in its own forum and at the right time, by appealing to the Constitutional Council, presenting the impugned documents for filing as an incident of documentary falsity.
"Subsequently, the Constitutional Council dismissed the appeal on the grounds that it had not found any evidence of falsity in the minutes of the public notices presented by the National Electoral Commission (CNE)," reads the PGR's communication.
The PGR adds that "since there has been a decision by the Constitutional Council on the matter, the Public Prosecutor's Office cannot give its opinion, since that body decides in the last instance, and there is no room for a new assessment".
"Accordingly, the Public Prosecutor's Office has dismissed the complaint for lack of legal grounds and ordered it to be closed," he concluded.
