Hidden Debts: Finally PGR reacts to the decision taken by the UK Court of Appeal

Mozambique will appeal the UK Supreme Court's decision regarding the legitimacy of the London Court to hear the Mozambican State's claims in the Hidden Debts case.

According to the statement from the Attorney General's Office (PGR), this follows the decision taken last week by the panel of judges of the UK Court of Appeal, authorizing Mozambique to appeal the decision taken in March 2021, which favored Privinvest.

In dispute is the competent jurisdiction to judge the case initiated by the Attorney General of Mozambique, against Privinvest.

Mozambique wants the case to be judged by a court of a sovereign state, while Privinvest argues that the case should be judged in an arbitral forum.

This is a civil lawsuit that the Attorney General's Office filed, representing the Mozambican State, with the Commercial Section of the Judicial Court of London in 2019 against Privinvest and others, in which the State requests payment for the losses that resulted from the undeclared debts, on the grounds that these, were contracted because of bribes that Privinvest paid.

The forum dispute has already gone through two instances and, with the authorization that Mozambique obtained to appeal, it will now be judged by the highest instance of British justice.
