CTA denounces lack of "clarity" in court order creating new electoral commission

The Confederation of Economic Associations of Mozambique (CTA) denounces the lack of clarity in the order issued by the Judicial Court of the Municipal District of Kampfumo, regarding the suspension of the effectiveness of the decision of the Board of Directors of the association, on the application of a disciplinary sanction against the Chamber of Commerce of Mozambique (CCM), represented by Álvaro Massingue, and the replacement of the electoral commission..

Through its lawyers Jaime Sunda and Salvador Nkamate, the CTA announced on Friday (02) in Maputo that the CTA's board of directors received on April 23, an order with registration number 17/25, in which the Mozambican Chamber of Commerce is the applicant.

The following order was made in the case in question: "The Judicial Court of the Kampfumo Municipal District decides to issue an injunction suspending corporate resolutions, suspending the effectiveness of the CTA's resolution of April 17, 2017, regarding the application of disciplinary sanctions to the Chamber of Commerce and its representative Álvaro Massingue."

According to the CTA's lawyers, on April 29, 2025, the same Kampfumo Municipal District Court notified the association of another order dated April 28, 2025, which changed the indication of the Decision, referring to the suspension of the effectiveness of the decision of the CTA Board of Directors of April 17, 2017 regarding the application of disciplinary sanctions to the applicant and his representative.

"In another order dated April 30, 2025, the Judicial Court of the Municipal District of Kampfumo replaced the electoral commission for the elections of the CTA's governing bodies," said Jaime Sunda.

Reacting to the orders, the lawyers for the country's largest employer believe that the three court decisions were "issued with an abnormal dispatch without the CTA having been given the opportunity to defend itself".

"These measures taken, especially the one contained in the latest order, are not included in the claims made by the applicant for the injunction in her initial application," said lawyer Jaime Sunda, stressing that "changes to court decisions in the terms set out above call into question the principle of legal certainty and security, which in general terms is linked to objective elements of the legal order and the guarantee of legal stability."

"The decisions handed down by the court undermine legality. The CTA has already taken appropriate legal action to restore legality, respect for the statute and valid regulations," added the lawyer.

It should be noted that a hearing for the CTA is scheduled for next Monday (05) at the Kampfumo Municipal District Court.
