CC rejects CAD's registration for legislative and provincial assembly elections

The Constitutional Council (CC) has rejected the registration of the Democratic Alliance Coalition (CAD) for the legislative and provincial assembly elections on October 9, according to Ruling 10/CC/2024 of July 31.

The decision follows a request submitted by CAD asking for the annulment of the decision of the National Electoral Commission (CNE) which, through Resolution No. 82/CNE/2024 of July 17, declared CAD's candidacy null and void, and consequently for the CC to order the CNE to accept CAD's closed plurinominal lists to participate in this year's Legislative and Provincial Assembly Elections.

Among other reasons, according to the CNE, the CAD is legally non-existent because it did not meet the legal requirements for submitting candidacies for its closed multi-nomination lists at the time of submission to the CNE.

CAD's application would have been negatively affected by irregularities concerning communication, registration, scope and legal personality.

The CC decided to annul CNE Decision no. 59/CNE/2024 of May 9, which accepted the registration of CAD, as well as to "consider CAD as not registered for electoral purposes, which precludes [prevents], consequently, the possibility or the right to present candidacies under the terms of article 177 of Law no. 8/2013, of February 27, amended and republished by Law no. 2/2019 of May 31".
