The Supreme Court (SC) wants to improve the process of appointing its staff, namely the President and his deputy, by removing the figure of the President of the Republic from this formal process. It is proposed that this be done through the judges advisors.
According to TS spokesman Pedro Nhatitima, who was speaking this Tuesday in an interview with STVThe aim is to give the body greater freedom from political power.
"We have already begun a process of reflection in order to improve this process of appointing the president and vice-president. It's a formal matter. The improvement is in the sense that, in the event of a constitutional revision, it will be possible for these two entities to be appointed from among their peers, the judge councilors," he revealed.
However, he clarified that the presidential model used in Mozambique to appoint these figures is the same as that used in the United States, and that in this system "powers are concentrated in the figure of the President of the State".
"We want the system to be transparent. We're not surprised that, in the future, these two entities could be proposed by their peers and, from a formal point of view, the appointment come from the head of state," he said.
He acknowledged that even with this appointment formula, there could still be a risk to the independence of the TS. He stressed that the formal guarantees for the body's freedom to act are in place, but that the human volatility of deviating from them "is subjective. It is difficult to gauge this subjectivity".
"But from an objective point of view, the architecture of the building effectively allows the president of the Supreme Court and the vice-president to carry out their responsibilities in peace," he said.
He was talking in the interview about the independence of the courts in Mozambique.
