The Sixth Chamber of the Maputo City Judicial Court recently removed 10 properties from the management of the defendants in the "hidden debts" case.
According to information provided by "Carta", these are properties seized in 2021 and still managed by the defendants as trustees.
The decision was taken last week (on October 9) by Judge Efigénio Baptista, after receiving a request from the Public Prosecutor's Office, reporting difficulties that were being faced by the National Directorate of State Assets (the entity appointed as trustee of the assets seized in the "hidden debts" case) in the management of these properties.
According to the "Letter" which quotes the Order issued by Efigénio Baptista, one of the difficulties stems from the fact that Ndandula Empreendimentos, Lda. (owned 75% by Alexandre Chivale, secret agent and lawyer for António Carlos do Rosário), has extended its right to manage eight apartments in the Deco Residence building (Av. Eduardo Mondlane), six apartments in the Paraíso de Férias building (Av. Marginal) and three commercial establishments (in Zimpeto).
Another difficulty, says the order quoted by the newspaper, is due to the fact that the representatives of this company (Mirza Betina and Flávia Manuel) have not been channeling the rents from these properties to the Treasury since they were seized in March 2021.
The order (11 pages long), in which the court agrees with the Public Prosecutor's Office that the powers conferred on managers or administrators cannot be exercised arbitrarily, covers properties owned by Renato Matusse, Ângela Leão, Bruno Langa, António Carlos do Rosário and Teófilo Nhangumele.
These are, specifically, a type 3 apartment, located in the Serafim Building, on Avenida Julius Nyerere, in the city of Maputo, belonging to Renato Matusse; a three-storey villa, located in the Jonasse neighborhood (Matola-Rio), belonging to Ângela Leão; and a villa located in the Garden Park Premium Condominium, in Matola, bought by Teófilo Nhangumele.
Also removed from the defendants' management were a type 3 apartment, located in the Garden Park Premium Condominium, in Matola, belonging to Bruno Langa; three properties located in the Deco Residence building, on Avenida Eduardo Mondlane, in the city of Maputo, belonging to António Carlos do Rosário; and three commercial establishments, located on Avenida do Grande Maputo, in the Zimpeto neighborhood, on the outskirts of the country's capital, also belonging to António Carlos do Rosário.
The court also ordered Ndandula Empreendimentos, Lda, represented by Mirza Betina, to deposit the rent for the six properties owned by António Carlos do Rosário in an account with the Bank of Mozambique within five days. The amount should cover the period from March 2021 to October 2023.
O file of the properties seized as part of the "hidden debts" is still on trial, and the case is before the High Court of Appeal, where the defendants have appealed against the decision taken by the court to drag all the assets to court. (Letter)
