Mozambique recently set a new legal regime for foreign nationalswhich establishes the rules for their entry, stay and exit from the country. The measure adopted comprehensive rules for children under 18 years of age.
According to Ágata Chiconela, Head of Legal Advice at RSM, who provided the information, this is a measure by the legislature based on a "normalized" practice outside the law.
"In fact, it was decided to legalize what was already happening, in other words, there was now legal coverage for what people were already doing," Chiconela explained, pointing out that "there was a legal gap" in the legal system.
Thus, for children under the age of 18, if they are not accompanied by their parents, they must present written authorization from their parents or the person exercising parental authority, in Portuguese or translated and notarized by the competent authorities, at the time of entry and/or exit.
However, when accompanied by one of the parents - a written authorization from the other parent must be presented at the time of entry and/or exit, expressing their consent to the minor's trip, in Portuguese or translated, with notarization by the competent authorities.
